1. About Us

Elements of Truth is a trivia board game published and sold by Electrify US LLC, a limited liability company organized under the laws of Delaware. ("we", "us", or "our"). Our products are available globally through our online store at https://elementsoftruth.game/. (the "Store") and through authorised retail partners. These Terms apply only to purchases made through the Store and do not apply to purchases made through third-party retailers, distributors, or marketplaces, which may be subject to their own terms and policies.

2. Scope and Acceptance

These Terms and Conditions ("Terms") govern all purchases made through our Store.

By clicking “Place Order,” “Buy Now,” or a similar button, or by otherwise completing checkout, you agree to these Terms. Your order is an offer to purchase the applicable product. We may accept or reject your order in our discretion. We will contact you to confirm receipt of your order, but that confirmation does not mean that your order has been accepted. Your order is accepted when we send an order acceptance or shipping confirmation to you via email. If we reject or cancel your order after your payment method has been charged, we will issue a refund to the original payment method.

These Terms apply to consumers and commercial buyers alike. Where applicable law grants additional rights to consumers, those rights are not affected by these Terms.

3. Products

All products listed in our Store are subject to availability. We reserve the right to discontinue any product at any time without notice.

We make every reasonable effort to ensure that product images, descriptions, and specifications are accurate. However, slight variations in colour, packaging, or component presentation may occur between the product images shown and the physical item received.

Elements of Truth is intended for players aged 14 and above. The game contains questions of varying difficulty across science, technology, engineering, and mathematics topics.

4. Pricing and Payment

All prices are listed in US Dollars (USD) unless otherwise stated at checkout. Prices are exclusive of shipping costs, handling charges, taxes, duties, or other charges unless expressly stated, which are calculated and displayed at checkout before you submit your order. See below for information about taxes and duties.

We accept the following payment methods:

• Credit and debit cards (Visa, Mastercard, American Express, Discover, JCB, UnionPay, Diner’s Club, Elo)
• PayPal

Payment is processed at the time of order. We use secure third-party payment processors and do not store your full payment card details on our systems.

5. Sales Tax and Duties

Depending on your location, sales tax, VAT, GST, or other applicable taxes may be applied to your order at checkout. The applicable tax rate is determined by your shipping destination and is displayed before you confirm your purchase. If we do not collect an applicable tax, you may still be responsible for paying it where required by law.

For international orders, customs duties, import taxes, and local fees may apply upon delivery. These charges are the sole responsibility of the buyer and are not included in the purchase price or shipping cost shown at checkout. We recommend checking with your local customs authority before placing an order if you are uncertain about applicable duties.

6. Shipping and Delivery

6.1 Shipping Destinations

We ship globally. Shipping options, carriers, and estimated delivery timeframes are displayed at checkout based on your delivery address.

6.2 Estimated Delivery Times

Delivery timeframes are estimates only and are not guaranteed. Delays may occur due to customs processing, carrier disruptions, or events outside our reasonable control. If we are unable to ship your order within the timeframe provided, or within the time required by applicable law if no timeframe is provided, we are not liable where such delay is caused directly or indirectly by third-party carriers or customs authorities.

6.3 Shipping Costs

Shipping costs are calculated based on the weight, dimensions, and destination of your order and are displayed at checkout prior to payment. Shipping costs are non-refundable except where an order is cancelled before shipment or where we are at fault.

6.4 Risk of Loss

Risk of loss or damage passes to you upon physical delivery of the product to you (or to a person designated by you to take delivery). Until that point, risk remains with us, except to the extent loss or damage is caused by an incorrect shipping address provided by you, your failure to accept delivery, or another act or omission by you. We recommend retaining your tracking information until your order has been received in satisfactory condition.

6.5 Failed Delivery

If a delivery attempt fails due to an incorrect address provided by you, or if a package is unclaimed and returned to us, we reserve the right to charge additional shipping costs to redeliver the order (capped at the same cost of the original delivery cost).

7. Order Cancellation

Orders may be cancelled before shipment by contacting us at team@electrify.video. Once an order has been shipped, it cannot be cancelled and must instead be processed as a return in accordance with Section 8.

We reserve the right to cancel any order at our discretion, including in cases of suspected fraud, pricing errors, or stock unavailability. In such cases, a full refund will be issued to the original payment method if your payment method has been charged.

8. Returns and Refunds

8.1 Return Window

You may return your order within 30 days of the delivery date, provided the product is returned in its original, unopened condition and original packaging, with proof of purchase.

8.2 How to Initiate a Return

To initiate a return, please contact us at team@electrify.video with your order number and reason for return. We will provide you with return instructions. Return shipping costs for voluntary returns are the responsibility of the buyer unless the return is due to a defective, damaged, or incorrect item or applicable law requires otherwise.

8.3 Refunds

Once we receive and inspect the returned item, we will process a refund to the original payment method within 10 business days. Original shipping costs are non-refundable unless the return is due to our error or a product defect.

8.4 Defective or Incorrect Items

If you receive a defective, damaged, or incorrect item, please contact us within 14 days of delivery at team@electrify.video with your order number and photographic evidence. We will arrange for a replacement or full refund at our discretion, including return shipping costs where applicable.

8.5 Non-Returnable Items

The following items are not eligible for return:

• Products that have been opened or used
• Products damaged due to misuse or improper handling by the buyer
• Digital downloads or digital content

8.6. Your Consumer Rights

Nothing in these Terms limits any non-waivable rights you may have under applicable consumer protection laws. If you are located outside the United States, you may have additional rights under the laws of your country of residence. 

For consumers located in the United Kingdom, these Terms, and in particular Sections 8.1-8.5 above, are in addition to your statutory rights under the Consumer Rights Act 2015, which are as follows:

1. Goods must be of satisfactory quality, fit for purpose, and as described. If they are not:

• Within 30 days of delivery: you have the right to reject the goods and receive a full refund.
• After 30 days: you are entitled to a repair or replacement. If that remedy fails or is unavailable, you may claim a price reduction or a refund.

1. You have 14 days from the day after delivery to cancel your order without giving a reason. To exercise this right, notify us at the email address listed above. We will refund the price and standard delivery cost within 14 days of receiving the returned goods (or evidence of return). You are responsible for return shipping unless the goods are faulty or misdescribed.

9. Intellectual Property

All content associated with Elements of Truth, including but not limited to the game name, logo, card designs, question content, rulebook, and packaging, is the intellectual property of Electrify US LLC or its licensors and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any Elements of Truth content without our prior written consent. All rights not expressly granted to you in these Terms are reserved by us and our licensors.

10. Question Content and Accuracy

The question and answer content included in Elements of Truth has been developed and reviewed with care. However, scientific understanding evolves over time and some answers may become outdated. Where questions reference specific definitions, standards, or contexts, these are noted in the accompanying question references available at https://elementsoftruth.game/pages/question-references.

We reserve the right to update question references and clarifications on our website without notice. Updates to physical game content will be addressed through future editions or expansion packs at our discretion.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Electrify US LLC shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your purchase or use of our products, including but not limited to loss of enjoyment, loss of data, or loss of profits.

Subject to the paragraph below, our total liability to you for any claim arising from or relating to a purchase shall not exceed the purchase price paid for the relevant product.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or such other liability that cannot be excluded or limited by applicable laws under your jurisdiction.

Your personal data is collected and processed in accordance with our Privacy Policy, available at https://elementsoftruth.game/pages/privacy-policy. Please review our Privacy Policy before placing an order.

13. Cookie Policy

Our Store uses cookies and similar tracking technologies as described in our Cookie Policy. Please refer to the “Cookies, Analytics and Similar Technologies” section of our Privacy Policy https://elementsoftruth.game/pages/privacy-policy for further information. You may manage your cookie preferences at any time through the cookie consent banner on our website.

14. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of Nevada, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your purchase shall first be attempted to be resolved through good faith negotiation. If unresolved, disputes shall be subject to the exclusive jurisdiction of the state and federal courts of Clark County, Nevada.

For consumers located in the United Kingdom or the European Union, you retain the right to bring claims before the courts of your country of residence.

If any provision or part-provision of these Terms is or becomes invalid, illegal or unenforceable under applicable law, it shall be deemed deleted, but that shall not affect the validity and enforceability of the rest of the Terms.

15. Changes to These Terms

We reserve the right to update these Terms at any time. The version applicable to your order is the version in effect at the time your order is placed. We will provide reasonable notice of material changes by posting the updated Terms on our Store.

We can assign or transfer these Terms, in whole or in part, in connection with a merger, acquisition, reorganization, sale of assets, change of control, or by operation of law, provided that the assignment or transfer will not materially reduce your rights under these Terms.
